Warranty
This page explains the warranty that applies to work carried out by 4Fixing. It follows Article 17 of our General Terms and Conditions, which is the text that governs the Agreement. Where this page and the Terms differ, the Terms apply.
Your statutory rights come first
Goods, digital content and digital services supplied to consumers must conform to the Agreement and to the expectations protected by Dutch law (Article 17.1).
Our Terms do not impose a fixed expiry date on statutory conformity rights (Article 17.2). There is no cut-off after six months, or after any other period we set ourselves. How long you can rely on conformity depends on the product, the price and what you could reasonably expect of it.
Repair services are performed with reasonable professional care and in accordance with the agreed specification. Your statutory rights and remedies remain unaffected (Article 17.3). Nothing on this page shifts a statutory burden of proof onto a consumer, and nothing here requires a consumer to pay for a remedy that the law requires to be provided free of charge (Article 17.10).
Our three-month commercial warranty
A commercial warranty is an additional promise. It comes on top of the law and never reduces a statutory right (Article 17.4).
Unless a longer period is stated in a durable warranty certificate, 4Fixing offers a three-month commercial warranty on the workmanship and the replacement part identified on the repair invoice. The period begins when the completed repair is delivered or made available for collection (Article 17.5).
Cover is tied to the repair on that invoice: the work we performed, and the specific part we fitted. Where a warranty certificate is issued, it identifies the provider, the beneficiary, the territory, the duration, the covered repair or part, the remedy, the claim procedure and the relevant exclusions, and it confirms that your statutory rights remain unaffected (Article 17.6).
Lifetime and extended cover
Our standard commercial warranty is three months. A lifetime or extended warranty applies only where a warranty certificate expressly states it and defines what the stated duration means. A general reference to a lifetime warranty on a website does not create unlimited or undefined cover (Article 17.7).
What the commercial warranty does not cover
Unless mandatory law provides otherwise, the commercial warranty does not cover (Article 17.8):
- a fault other than the one that was repaired;
- accidental damage;
- misuse;
- later exposure to liquid;
- unauthorised alteration;
- malware;
- incompatible software;
- wear of consumable parts;
- a condition that we disclosed as falling outside the scope of the repair.
These exclusions limit the commercial warranty only. They do not limit the statutory rights described above.
Your data is not covered by the warranty, so back it up first
Repair, board work, software intervention, failed storage and Data Recovery inherently involve a risk of data loss, corruption, reset, loss of encryption access, changed file structure or permanent inaccessibility (Article 13.4).
4Fixing does not guarantee that data will remain intact unless a specific written guarantee is given. Where we say that we aim to preserve your data, that describes the method we intend to use, not a result we promise (Article 13.5). Please make a current backup before handing over a device, wherever a backup is reasonably possible (Article 13.1). The absence of a guarantee does not excuse a failure to use reasonable professional care, and does not exclude liability that cannot lawfully be excluded (Article 13.6).
How to make a warranty claim
Contact us as soon as you notice the problem, by email at info@4fixing.com, by telephone on +31 6 86475803, or by post or in person at Witte de Withstraat 114H, 1057 ZG Amsterdam.
Please identify the Agreement, the device or the project, describe the issue, give the relevant dates and state the solution you are asking for, and include the supporting information reasonably available to you, such as the repair invoice or the repair confirmation (Article 30.2).
4Fixing must be given a reasonable opportunity to inspect the alleged defect and, where appropriate, to remedy it. Please do not allow a third party to alter the repaired area before that inspection, unless urgent action is reasonably necessary (Article 17.9).
We will acknowledge or substantively respond within 14 days (Article 30.4). The full procedure is set out in our complaints procedure.
Right of withdrawal
We conclude agreements at our workshop in Amsterdam. An agreement made on our premises does not become a distance contract merely because later communication takes place electronically (Article 9.6). For that work there is no statutory right of withdrawal, because the right applies to agreements concluded at a distance or away from our business premises.
Should an agreement with a consumer nonetheless be concluded at a distance or away from our premises, for example the sale of goods to a consumer who has not visited the shop, that consumer does have the statutory right of withdrawal, unless a lawful exception applies (Article 9.1). The points below apply to those cases.
- For goods, the applicable period normally begins after you receive them, subject to the statutory rules for split or multiple deliveries. For services, the period is normally 14 days from formation of the Agreement (Article 9.2).
- If you ask 4Fixing to begin a service during the withdrawal period, that request must be express. If you then withdraw before the work is complete, 4Fixing may charge the lawful proportion for the work already performed (Article 9.3).
- The right of withdrawal for a service ends after full performance only if you expressly requested or consented to early performance and acknowledged the statutory consequence before performance began (Article 9.4).
- An exception for custom-made goods or digital content applies only where all statutory conditions have been met and you were correctly informed before the Agreement was formed (Article 9.5). If another statutory exception applies to your case, we will state it clearly before the Agreement is concluded.
- To withdraw, notify us. You may use the model withdrawal form at the end of our Terms, or any other unambiguous statement, by email, by post or in person. Where legally required, 4Fixing will also provide an accessible online withdrawal or cancellation function (Article 9.7).
